WMD拡散防止を目指す国際的な枠組み、国連安保理決議1540について

大量破壊兵器の拡散を防止するための国際的な枠組みが
国連安全保障理事会決議1540。

この国連安保理決議1540は、国連憲章第7章に基づき、
採択されたものなので、国連加盟国に法的拘束力を及ぼすものだが
要請されたことを履行する段階となると
加盟国の中には、そもそも決議で言われていることが
何なのか分からなかったり、
また、防止するための措置を講じるための
人材がいなかったり、行政の能力が及ばなかったりで
履行の確保に向けた課題が残っていると
決議1540委員会も報告している。

決議1540の履行確保には、地域的機構の役割が重要である
と指摘するのが、国連軍縮研究所と
軍縮・軍備管理分野で有名なモントレー国際研究所による
共同研究をまとめた論文。

同論文の内容を紹介する。
英文がめちゃくちゃなところが多くて、ちょっと翻訳が難航した。
自身の関心の強い分野ということもあったのだが
何気にいちいち訳すまでもなかったかもと後悔もしている。

Introduction

United Nations Security Council Resolution 1540 (2004) is one in a series of measures taken to address threats to the political and social order deriving from access to, or use of, weapons of mass destruction (WMD), related materials, and means of delivery. The resolution is distinct from existing treaty-based nonproliferation and arms control regime components, such as the Nonproliferation Treaty (NPT), the Chemical Weapons Convention (CWC), and the Biological and Toxin Weapons Convention (BTWC) that govern the behavior of states.
国連安全保障理事会(安保理)決議1540(2004年に採択)は、大量破壊兵器(WMD)やその関連物資、もしくは運搬手段の入手、ないし使用により生じる、政治的・社会的秩序を揺るがす脅威に対処するための、一連の取り組みの一つを具体化したものである。決議1540は、国家の行為を規制する核拡散防止条約(NPT)や生物・化学兵器禁止条約(BTWC、CWC)のような、既存の条約を基礎としている不拡散・軍備管理レジームとは一線を画している。

In contrast to these treaties, resolution 1540 in one instrument, covers all three types of weapon and reaches beyond the state to focus explicitly on the risk that non-state actors, in particular terrorist organizations bent on undermining, and in some cases supplanting, civil society might "acquire, develop, traffic in or use nuclear, chemical and biological weapons and their means of delivery." 1540 also goes beyond existing anti-terrorism conventions that collectively impose similar though less comprehensive obligations on convention parties in that, being adopted under Chapter VII of the UN Charter, the resolution is binding on all member states of the United Nations.
核兵器、化学兵器、生物兵器という三種類の大量破壊兵器のすべてを扱う国際法文書の一つである決議1540は、既存の条約とは異なり、規制対象を国家だけに限定せず、市民社会の土壌を蝕むばかりか、ときに市民社会に取って代わり、「核、および生物・化学兵器とその運搬手段を獲得、開発、密売、もしくは使用する」恐れのある非国家主体も含めている。決議1540はまた、既存の対テロ条約とも異なる。対テロ条約の当事国に課せられる義務は、包括的とは言い難い一方で、決議1540は国連憲章第7章の下で採択されており、全ての国連加盟国を拘束する。

Specifically, 1540 requires that all states "refrain from providing any form of support to non-state actors that attempt to develop, acquire, manufacture, possess, transport, transfer or use nuclear, chemical or biological weapons and their means of delivery"; and, consistent with national procedures, to "adopt and enforce appropriate effective laws" to foreclose the possibility of any non-state actor taking any of the above mentioned steps. Coverage extends, among other things, to accounting and security of items listed in the resolution, export and transshipment controls, border controls, including illicit trafficking, and physical protection.

The obligatory nature of the resolution raises the question of implementation. This is, for many states, a daunting task. As noted in an early analysis of the Resolution, "This is especially true for many of the world's developing states, some of which, even if they have the will to do so, lack the necessary resources. States particularly affected are those which are not already parties to the relevant WMD treaties (NPT, CWC, BTWC) and do not therefore already have the appropriate measures in place — and those which, although parties, have not fully implemented their obligations."[2] Beyond political will — which is lacking in many cases either because the challenges addressed in 1540 are seen as remote from a given country's concerns and as an effort by the United States and its allies to force the entire international system to partake in the "War on Terrorism" — there is the question of human, structural, and institutional capacity.

Sources of support in meeting the objectives of 1540, beyond self-help, include: direct bilateral assistance; assistance from specialized international organizations, such as the International Atomic Energy Agency (IAEA) and the Organisation for the Prohibition of Chemical Weapons (OPCW); multilateral organizations, for example Organization for Security and Cooperation in Europe; non-governmental entities, such as the Stockholm International Peace Research Institute and the Verification Research, Training and Information Center; and regional and sub-regional organizations, which are the focus of this paper, as well as a major joint United Nations Institute for Disarmament Research (UNIDIR) and Monterey Institute of International Studies (MIIS) study, Implementing Resolution 1540: the Role of Regional Organizations.

Why focus on regional and sub-regional organizations?
なぜ地域的・準地域的機構に注目するのか

There are several reasons why it makes sense to explore the role of regional organizations in implementing resolution 1540. First, Chapter VIII of the UN Charter encourages regional organizations to take appropriate actions to maintain international peace and security. Second, in the case of 1540, there is a record of support — including the former UN Secretary General, Kofi Annan, the two most recent 1540 Committee Chairmen, as well as a number of UN member states — of regional and sub-regional organizations playing an important role in the implementation process.[3] Third, UN Security Council Resolution 1673, which extended the 1540 Committee for two years in 2006, reaffirmed that sentiment, and this past April, the Security Council was even more explicit when passing UN Security Council Resolution 1810. That resolution extended the 1540 Committee for three more years and encouraged that body "to engage actively with States and relevant international, regional and sub-regional organizations to promote the sharing of experience and lessons learned in the areas covered by resolution 1540 (2004), and to liaise on the availability of programmes which might facilitate the implementation of resolution 1540" (paragraph 11.d) and requested "the 1540 Committee to provide opportunities for interaction with interested States and relevant international, regional and sub-regional organizations to promote implementation of resolution 1540 (paragraph 11.e).

Fourth, regional and sub-regional organizations tend to have a high degree of political legitimacy and enjoy a high level of confidence among their members. These organizations consist of states that voluntarily joined together on the basis of shared values, interests, history, experience and objectives, thus offering a greater prospect of achieving agreement and consistency regarding how to address, implement, and sustain a mandate that is binding on them all. While the UN also enjoys legitimacy and confidence among its members, a number of states raised serious questions about the legislative nature of 1540 and appropriation by the Security Council of authority and power normally associated with sovereign states. This concern is dissipating — or at least not brought up in the public domain as frequently as in the years after 1540 passed — and can be further ameliorated by greater involvement of regional and sub-regional organizations taking steps, consistent with relevant traditions and practices, to seek harmonization of national laws and practices for the region as a whole.

A fifth, related consideration is that regional organizations can play an important role in achieving a common understanding and interpretation of steps to take to ensure that their members work together to close gaps in 1540 implementation and to remedy inconsistencies which, if left unchecked, could undermine the common good of the member states and the broader international community. This would include focusing on legislative measures, relevant appropriate administrative structures, and training of personnel. In particular, regional and sub-regional organizations can assist members in identifying needs, capacity-building, resource assistance, cost sharing and the like, and in assuring that actions taken by their members are mutually reinforcing so as to avoid there being a weak link in the chain of measures taken by the region as a whole that could undermine the security of one's neighbors while nevertheless respecting cultural, legal, and conventional attributes of its members.
第5に、関連した見解として、地域的機構は、決議1540の要請について共通の理解と解釈を醸成する上で、重要な役割を果たしており、加盟国による決議1540の履行状況の格差を減らし、もし、加盟国間、より広くは国際共同体における共通善を蝕むような慣行の不一致が野放し状態になっていた場合、そうした状態を是正している。これには、国内立法措置や関連の適切な行政機関、人員の訓練が注目される。地域的・準地域的機構は、ニーズの確認、能力強化、資源開発支援、費用の共同負担などで加盟国を支援するとともに、地域全体として取っている行動の鎖の中で、加盟国の文化的、法的、慣習的態度を尊重する半面、近隣国の安全を損なうような結び付きの弱い部分が生じることを避けるため、加盟国が相互に取り組みを強化し、行動を確保していけるようにすることができる。

In short, authority, legitimacy, and confidence are all issues in play and regional organizations are one means — an important one — by which to address them. They enjoy legitimacy among their members and they have authority deriving from mandates granted by their member states. Because of these attributes, regional organizations are in a position to direct and assist member states in a variety of ways that might be seen as intrusive if coming from a global organization or powerful out-of-region states whose direct involvement might be interpreted in neo-colonial terms. They enjoy a high degree of confidence among their members, notwithstanding differences that may arise on specific issues.
すなわち、権威や正統性、信頼性は、すべての問題に影響をおよぼしているもので、地域的機構はそれらの要素を備えた唯一の――重要な――手段なのである。地域的機構は加盟国に対して正統性を有し、加盟国が合意した決議を基に権威を持ち得る。こうした特性故に、地域的機構は、普遍的機構や地域の外の大国による、新植民地主義とも解釈され得る直接的な関与のように、押し付けがましいと思われるやり方で、加盟国を指図し、後押しする立場にあると言える。

Case studiesケース・スタディ

No country is in full compliance with all provisions of resolution 1540, but implementation challenges appear more prevalent in South-East Asia and the Pacific, Latin America, and Africa. As a result, those were the regions focused on in the UNIDIR-MIIS study.

Monica Herz writes in her chapter of the aforementioned study that in Latin America "a regional effort is needed in order to deal with the perceived legitimacy gap of [resolution 1540] and the lack of capacity of some states to implement 1540 and to face the dangers of access to weapons or agents used for the production of weapons by non-state actors" and "the [Organization of American States (OAS)] has developed institutional mechanisms that can be geared towards a supporting role for the implementation of 1540 in terms of the objective dimension, that being the development of capabilities lacking in certain parts of the region, and in terms of the subjective dimension, that being generating regional debate on the normative framework the resolution puts forward and increasing its legitimacy."
前述の共同研究の成果をまとめた論文で、ラテンアメリカの章を書いたモニカ・ヘルツ氏は「決議1540の正統性をめぐる認識の格差や、決議を履行する能力がない国に対処するため、また、兵器、もしくは非国家アクターの兵器製造に利用される物資の取得という危険に立ち向かうためにも、地域的な努力は必要である」と指摘する。また、ヘルツ氏によると、「米州機構(OAS)は、客観的な次元では、決議1540を履行する能力が欠如している地域の能力を強化するための役割を果たす制度的メカニズムを整備し、主観的な次元では、決議の規定の規範的な枠組みについて、地域的な議論を進める場を設け、決議の正統性を高めていっている」という。

Recognizing that there are regional differences within Latin America, this region is the most advanced of the three regions being examined insofar as levels of 1540 implementation and the potential of the major regional organization, the OAS, to play an important role. The OAS has in recent decades increased its engagement in security-related matters and created infrastructures to reflect that intensification. Since the end of the Cold War, such new OAS agencies include the Committee on Hemispheric Security and the Inter-American Committee Against Terrorism (CICTE).

CICTE provides OAS member states with a forum in which they can discuss and share information about developing activities for training and crisis management, border cooperation, and travel documentation security measures in connection to the terrorism threat. CICTE also has programs in airport security, customs and border protection, cyber security, legislation against terrorism, port security, terrorist financing, terrorism policy engagement exercises, and tourism security. Topics on the agenda of the Committee on Hemispheric Security include trafficking in arms (conventional) and persons, fighting transnational organized crimes, and nonproliferation of nuclear weapons and nonproliferation education.

One early indicator that the OAS was going to be involved in the 1540 implementation process was a special meeting organized by the Committee on Hemispheric Security in 2004 on combating the proliferation of nuclear, chemical and biological weapons, their delivery systems, and related materials within the framework of Resolution 1540. Since then, three outreach seminars, more than any other region, have taken place in Latin America and the Caribbean focusing on 1540 implementation (Buenos Aires, Argentine in 2005, Lima, Peru in 2006, and Kingston, Jamaica 2007). Support for Implementation at the Hemispheric Level of United Nations Security Council Resolution 1540 is also one of the themes that are being debated by the Committee on Hemispheric Security in 2008. Writes Herz in on the Committee on Hemispheric Security and CICTE in connection to resolution 1540: "it is possible for the OAS to play a role in supporting compliance with 1540...Institutional structures that are in place such as the Committee on Hemispheric Security and CICTE can get involved in the subject, generating debate and assistance programmes, sharing information and producing verification mechanisms where they cannot be generated by the state."

2. South-East Asia and the Pacific

Without intruding on the principles and traditions of consensus-based decision making, non-interference, and informal dialogue, it would seem that there are opportunities for the Association of South East Asian Nations (ASEAN) states to take steps to address and promote the mandate of 1540 in a way that maximizes implementation of the objectives of the resolution and avoids the risk of weak links in the chain, recognizing that consistency in scope and measures serves the security interests of each state and of the region as a whole and reduces the risk that non-state actors, illicit traffickers, and terrorists will be able to use the territory of any ASEAN state to promote and carry out their nefarious activities.
コンセンサスによる意思決定という原則と伝統を押し付けず、不干渉主義を貫き、会議も非公式であれば、東南アジア諸国連合(ASEAN)の加盟国が、決議1540の履行を最大限に拡大し、決議の履行が弱い地域で生じ得るリスクを回避し、適用範囲と取られる措置が一貫していることが、ASEAN加盟国とその地域全体における安全保障上の利益を確保し、非国家主体や違法な密売人、テロリストなどがASEAN加盟国の領土で、悪質な行為に至るという危険性を減らすことができるとの認識を共有することにより、決議の条項を踏まえた取り組みを進めるための一歩を踏み出すことができるように思われる。

Identifying the threats, vulnerabilities and risks for all members of ASEAN, as well as agreeing on the nature of measures to be taken to protect oneself and each other pursuant to the legal and institutional foundations of each state involved, should be an objective on which all states could agree. Where assistance in achieving common objectives is needed ASEAN could serve as a vehicle for facilitating access from relevant outside sources. Bilateral assistance also would work but to the extent that states would prefer not to have bilateral involvement out of concern of a more intrusive involvement in national activity by an outside state, ASEAN could stand as an appropriate and acceptable means by which to address assistance requirements of its member states and in so doing be able to exercise some oversight over the consistency and compatibility of state measures in the interest of maximizing harmony and minimizing the risk of gaps in practice that could unintentionally undermine regional security as a whole.
ASEANに加盟する各国の法体制に従い、自国と他国を互いに保護するために取られる措置への合意と同時に、ASEAN加盟国にとっての脅威と脆弱さ、そしてリスクを認識するということで、すべての国が合意に至るという目的を果たすべきだろう。共通の目的を達成するために支援が必要であるところに、ASEANは、外部の関連するソースへのアクセスを可能にするための手段としての機能を果たすことができるだろう。二国間の支援も有効だが、ASEAN加盟国は、他国が国内で押し付けがましい行動を取ることを快く思っておらず、二国間の枠組みによる関与を好んでいないところがある。ASEANは、加盟国により支援の要請があれば、適切で、期待に添った役割を果たし得る。そうすることで、ASEANは、国家の行動が一貫し、両立しているかどうか、ある程度監視しながら、調和の最大化による利益を確保し、行動の不一致が、地域的な安全保障全体を無意識に損なうことになるというリスクを最小化させられる。

Decoupling actions taken from the "War on Terrorism" with which many do not identify, but recognizing that certain threats and risks do exist and need to be addressed and weaknesses remedied in the interest of keeping the region safe from terrorism is important. Again, there is the consideration that regional security writ large really depends on the avoiding of weak links in the chain, that is to say assurance that all relevant states are addressing a range of problems and that each state and the region as a whole stand to gain or lose depending on the extent to which there is, or is not, a seamless web of measures and capabilities in place and being implemented and, where assistance is needed, it is accessible.
「テロとの戦い」から切り離された行動というのは、あり得なくなってきている。脅威とリスクの存在を認識し、テロリズムから地域の安全を守ることで得られる利益を確保する中で、問題に取り組み、弱点を克服していくことが重要である。特に、地域的な安全保障は、規制の鎖の縛りが弱い部分を克服できるかどうかにかかっている。つまり、様々な問題に取り組むすべての関係国と各国、そして地域全体が、実施されている措置がどの程度均一であるのかどうか、どの程度問題に対処できる能力があるのか、決議はどの程度履行されているのか、支援が必要とされているのはどこなのか、支援はどの程度受け入れ可能なのかどうかについて、はっきりさせるということである。

In short, regional coordination is an optimizer that serves the interests of all and that can be achieved in a manner consistent with ASEAN traditions of dialogue, consensus and non-interference. A focus on overall regional coordination via ASEAN that respects the regional tradition and still takes agreed steps that work in the common interest and for common security need not undercut regional traditions and should not be seen as such.
要するに、ASEANの対話とコンセンサス、不干渉主義という伝統に則した形で、地域的な調整が成されれば、全体の利益を守れるのである。ASEANを介した地域的な調整全体に注目した場合、地域的な伝統が重んじられ、共通の利益おいて果たすべき役割に合意し、共通の安全保障の必要性が地域的な伝統を損ねることがないし、また損ねるようなことはあってはならないのである。

Cooperation and coordination are necessary for the region to benefit as a whole. One should want to avoid losing out in this regard because of unnecessary gaps between states which, in many respects, are interdependent. The key question is whether ASEAN can formulate and implement a strategy that ensures consultation, exchange of information, efforts to formulate a cooperative entity that, based on equivalence of approach, respects national differences, but nevertheless optimizes consistency and avoids the risk of the weak link in the chain. This applies to export controls, in particular strategic trade controls, border controls, focus on trans-shipment and transit activities — things that also provide enhanced security for a state in terms of concerns with drug and human trafficking, trafficking in small arms and light weapons, cross-border criminal activity that adversely affects the state, and the like.

In her chapter on South East Asia and the Pacific for the UNIDIR-MIIS study, Tanya Ogilvie-White offered recommendations for ASEAN and the ASEAN Regional Forum (ARF), taking into account the traditions and practices of those organizations. At one level she suggested that "there could be some potential to expand the work of the [ARF] Intersessional Meeting on Counter-Terrorism and Transnational Crime (ISM-CTTC) to include a more specific focus on the implementation of 1540 or to assign this work to a new body on WMD counter-proliferation, which is currently under discussion within the [ARF]." In addition she recommended that ASEAN and ARF should "consider establishing a dedicated entity within ASEAN to liaise with the 1540 Committee and oversee and coordinate 1540 implementation in South-East Asia; consider setting up a working group on counter-terrorism...to set goals and agree priorities; construct an ASEAN website to identify gaps and keep track of all cooperative WMD-related counter-terrorism initiatives taking place across the region;" and very importantly, "adopt the export controls template being developed by the CSCAP Export Controls Experts Group; this would create a peer review tool to assist in capacity building and monitoring and to encourage best practice in the area of export controls."

3. Africa

The WMD nonproliferation issue is, and has since the 1960s been, on the agenda of the African Union (AU), and its predecessor the Organization for African Unity (OAU). It should be noted at the outset that other issues that has a more direct impact on the social order of African nations, such as the AIDS/HIV epidemic, poverty, civil wars, and the increase and spread of Small Arms and Light Weapons (SALW), take priority on the third world continent. It is not that African countries are indifferent toward the WMD proliferation issue, but African states need to allocate political energy and scarce resources toward matters imperative to maintaining viable civil society.

Notwithstanding these realities, among other nonproliferation and arms control efforts, the OAU played a crucial role in promoting the NPT, contributing to today's universal adherence to that treaty in Africa — although numerous African states have yet to conclude comprehensive safeguards agreements with the IAEA, something that would indeed further 1540 implementation. The Pelindaba Treaty, establishing Africa as a nuclear-weapon-free zone (NWFZ), is another initiative where the OAU, in collaboration with the UN, played a critical role throughout the years. To date, the treaty does not enjoy the necessary 28 ratifications to go into force, however, recent ratifications have renewed the hope that a NWFZ in Africa may be realized.[4]

In recent years, Africa has also seen a significant increase in ratifications to the Comprehensive Test Ban Treaty and even though the OAU and AU have been less active in promoting such treaties as the CWC and BTWC over the years, signatures and ratifications have continued to trickle in. Further, the Peace and Security Council of the AU is designated to consider regional or international peace and security issues. One of its objectives is to "co-ordinate and harmonize continental efforts in the prevention and combating of international terrorism in all its aspects" and one must assume, considering the sufficiently well understood linkage between terrorism and WMD, that that article includes the problem that resolution 1540 addresses.

Specifically regarding resolution 1540, two outreach seminars have taken place in Africa, one last year in Gaborone, Botswana, and one in 2006 hosted by Ghana. In February 2007, Ghana's ambassador to the UN strongly endorsement the use of regional organizations in the 1540 implementation process:

The European Union, the Association of Southeast Asian Nations, the Caribbean Community, the Organization of American States, the League of Arab States, and the African Union...have the appropriate mechanisms for the pooling of resources for the implementation of such obligations under resolution 1540 as border controls and illicit financial networks within the regional context. Given their respective characteristics, they are able to develop more effective and contextually driven means to fulfill the obligations of resolution 1540, rather than simply transplanting measures from States with different values and cultures. Moreover, such bodies can place the fulfillment of the resolution on the regional agenda and thereby promote its universal adherence by all States in the region.[5]

Bearing in mind the current differences in saliency and urgency between SALW and WMD in Africa, there are also lessons to be learned by examining the work of African sub-regional organizations in implementing the 2001 UN Program of Action to Prevent, Combat, and Eradicate the Illicit Trade in Small Arms and Light Weapons in All Its Aspects (PoA).
アフリカにおいて、小型武器・軽兵器の拡散問題と、WMDの拡散問題では、各々の問題の突出性と緊急性において、違いがあることを念頭に置いた上で、2001年に国連で採択された、小型武器と軽兵器の非合法取引のあらゆる側面の防止、対策、および根絶のための行動計画(PoA)の実施における、アフリカの準地域的機構の役割を検証することで得られる教訓もあるだろう。

First, African sub-regional organizations — perhaps because they consist of a smaller and more homogenous membership and as a result are able to tailor their efforts even further to reflect sub-regional strengths and weaknesses — have, to a greater extent than the AU, been able to agree to and promote ratification of treaties, accords, and protocols in connection to the PoA. The Southern African Development Community's (SADC) Protocol on the Control of Firearms, Ammunition, and Other Related Materialsm is one example of a measure that covers comprehensive PoA implementation.

Another measure that in fact goes beyond PoA provisions is the Nairobi Protocol in the Great Lakes Region and the Horn of Africa. That protocol requires states to introduce controls on illicit manufacturing, import, export, and transit, capacity-building, awareness-raising, information sharing and cooperation, harmonization of legislation, and requiring states to incorporate specific provisions in national legislation. Resolution 1540 includes almost identical obligations with regard to WMD, and it is reasonable to assume that efforts focused on, for example, illicit trafficking of SALW should have positive impacts on preventing illegal transfers of WMD or vice verse. Taking steps in Africa, or in any part of the world, to meet the challenge posed by WMD, states also stand to strengthen their ability to confront the challenges posed to their security by other issues. Effective border controls designed to deal with radioactive material or, chemical or biological agents, can be relevant to efforts to deal with the drug and SALW challenges.

The same holds true for transit and transshipment controls. Laws, regulations and administrative measures focused on export controls to deal with illicit trafficking of dual use commodities such as ring magnets or maraging steel, which are relevant to nuclear activities, can also be a template for dealing with small arms, drug, and human trafficking challenges confronting a state (or region). The particular objective may differ, but much of the infra-structure needed to deal with one or another problem — illicit trafficking and SALW on the one hand, control over chemical, biological, nuclear materials and components on the other — may overlap in fundamental ways. Passing legislation, applying laws, creating infrastructure, training a corps of specialists to deal with strategic trade controls, border controls, and the like, can be a first step for a range of near term objectives, but such steps also can be adjusted and serve as a template to deal with other priority concerns of a state as noted above.

Second, coordinating organs within sub-regional organizations have played a crucial role helping to implement agreed-upon treaties, accords, and protocols. Such bodies have in some cases been relatively successful managing the sharing of information, harmonizing legislation, running awareness-raising programs, and lobbying governments to implement commitments. The Regional Center on Small Arms and Light Weapons (RECSA) in the Great Lakes Region and the Horn of Africa is a fully recognized independent sub-regional coordinating body with a legal mandate that facilitates implementation information-sharing and provides crucial assistance in harmonizing small arms legislation in the sub-region as agreed upon in the PoA.

RECSA is also the forum for regional workshops and seminars on small-arms legislation. In SADC, the Southern African Regional Police Chiefs Cooperation Organization has taken a leadership role, and a Task Team to address SALW issues has also been set up and mandated to lead sub-regional efforts to implement PoA. The Task Team in addition aims to study the potential for implementation of the SADC Protocol, using the Nairobi Protocol and RESCA in its coordinating role as a model. SADC looking at the Nairobi Protocol and RESCA is another lesson learned: sub-regional organizations can learn implementation and infrastructural lessons from each other.

Recognizing that there are other pressing issues on the African continent, and that the WMD issue currently receive relatively little political attention, it should not be ruled out that Africa, if motivated and provided with adequate resources, can continue to make progress with regard to WMD nonproliferation and international treaties, agreements, and resolutions, such as 1540. This is particularly true if other pressing issues noted above receive increased attention from outside states and international organizations.

Conclusion

The culture of the particular regions or regional organizations in question, resolution 1540 legitimacy deficit, priorities, and capacity are challenges to be considered when trying to utilize regional organizations in facilitating the implementation of resolution 1540. However, as can be seen from the specific cases above there are windows of opportunity in all three regions for the utilization of regional organizations in implementing 1540.
決議1540の履行促進に地域的機構を活用する場合、地域や地域的機構の文化の問題、決議1540の正統性の欠損、取り組むべき問題の優先順位、そして問題に取り組むための能力の有無などが課題となっていることを考慮する必要がある。しかし、上で見てきたように、三つの地域的機構は、決議1540の履行の促進に貢献できるという期待が持てるといえよう。

First, in contrast to some other regional organizations, whose scope may only encompass economic and cultural issues, international peace and security or regional security, is, if not the primary concern, at least increasingly important for the OAS, ASEAN, and African regional and sub-regional organizations. Second, these regional organizations have forums or bodies in which the mentioned issues are handled. Third, there are precedents showing that these regional organizations have been, or are currently actively involved in 1540 implementation activities, or activities similar to what would be required to implement 1540.

One specific recommendation to fulfill the potential for regional organization to play a role in the process toward 1540 implementation is to establish a unit dedicated to the 1540 agenda within the existing regional organization forums mentioned above, each of which have a broadly defined security focus covering terrorism, transnational illegal trafficking in all its aspects, and related cross-border criminal activities. An alternative would be to create an independent unit dedicated exclusively to implementing Resolution 1540. Such a unit within each regional (or where more appropriate, sub-regional) organization would be dedicated explicitly and exclusively to the implementation of the resolution, unlike the earlier mentioned entities that have a broadly defined security focus.

An independent unit could devote systematic, continuous attention to the WMD challenge while coordinating with institutions having broader but related missions. It could function as a bridge between the individual states, the regional organization and the 1540 Committee, but also liaise with sub-regional organizations and other institutions that have implementation resources available, such as the IAEA and the OPCW. Proposed entities could coordinate training, generate debate, provide for the sharing of information, establish best-practice guidelines and, in general, oversee the implementation of 1540.

In cases where sub-regional organizations were deemed to be more appropriate (likely the case for Africa with its great expanse and wide diversification in terms of levels of development, prioritization of issues confronting contiguous states and the like), they could take on these responsibilities. The work of these entities could also benefit the outreach activities organized by the UN and other organizations because they would be able to pinpoint the specific regional or sub-regional issues needing attention and recommend that they be the focus of seminars, assistance and other outreach activities. These proposed entities would coordinate a regional organization's efforts with regard to 1540 implementation, ensure that there is no duplication of work and that valuable resources would be utilized for their intended purpose and not wasted.

Notwithstanding the obligatory nature of Resolution 1540, states that see the issues that prompted the resolution as remotely, if at all, relevant to their own situations in terms of urgency, priority or allocation of scarce resources, may consider non-implementation of Resolution 1540 to be a totally rational act on their part. Ultimately, however, such decisions, if pursued by other states for any reason, would lead to continued or increased risk of the spread of WMD to terrorist organizations and undermine the common security of all—a situation described in academic literature as a "tragedy of the commons," wherein behavior driven by self-interest to maximize private gains (or minimize private costs) threatens common security.[6]
決議1540の強制的な性質にもかかわらず、国家による決議の履行促進に向けた取り組みはばらばらで、仮にすべての国が履行していたとしても、各国家がそれぞれの事態の緊急性をめぐる状況判断に照らして優先順位を付け、限られた資源を割り当てているのであり、決議1540の不履行ということも、ある側面では、まったく合理的な判断であるとも考えられる。しかしながら、いかなる理由であれ、国家が決議の不履行という選択をすれば、WMDがテロ組織に拡散し、すべての国にとっての共通の安全保障が脅かされるというリスクの持続と増大を招くことになるだろう。こうした状況は、アカデミックな表現を用いると、私的な利益を最大化(もしくは私的なコストを最小化)させるための自己利益を追求する行為が、共通の安全保障を脅かすという意味での「共通の悲劇」といえるものだろう。

In an age characterized by the rise of disaffected, alienated or apocalyptic movements, the last thing that we can afford is the existence of weak links in the chain of control over WMD, their components or their means of delivery. Today, common security can only be achieved by common efforts because, as pointed out by former UN Secretary-General Kofi Annan, "In today's world, the security of every one of us is linked to that of everyone else."[7] In other words, the global community can either collectively strengthen measures against WMD terrorism, as laid out in resolution 1540, or continue to face the same or increased risk of a terrorist organization acquiring and using a chemical, biological, or nuclear or radiological weapon with all the consequences that would entail for civil society and social order.
不信や孤立、もしくは終末論的な動向の台頭が、今の時代の特徴であるが、我々が最も避けなければならないことは、WMDやその部品、もしくは運搬手段の拡散を縛る鎖の結び付きの弱い部分を残したままにしておくということである。今日、共通の安全保障は、共通の努力によってのみ達成され得るのである。コフィ・アナン前国連事務総長が「今日の世界において、我々一人一人の安全は、他のすべての人の安全とつながっている」と指摘していた通りである。言い換えれば、我々は、グローバルな共同体として、決議1540の規定に従い、WMDを用いたテロを阻止するための措置を集団的に強化していくことができる一方で、さもなければ、テロ組織が生物・化学兵器、もしくは核・放射性兵器を獲得し、使用することで市民社会と社会秩序が脅かされるというリスクの増大に、直面し続けるということになるのである。

武器貿易条約の成立を目指すアフリカ諸国の団結

軍縮・軍備管理関連の条約をめぐる報道などでは
兵器の主たる生産・輸出国である米国が賛成したかどうかに
しばし大きな関心が寄せられることが多い。

一方で、こうした条約の成立には多数の国の支持が必要であり
例えば、特に国連総会の場で、条約に関連する決議を採択させる場合、
国連加盟国の大多数を占める途上国の動向が重要であると考えられている。
中でもアフリカ諸国の支持を得られれば、
決議採択への道筋が見えてくるため、
条約成立に向けた交渉において、まずはアフリカ諸国を説得することが
重要であるとも考えられているようだ。

今年末には、一連の政府専門家会議での検討を経て
最終報告書がまとめられる武器貿易条約については
その成立に向けて、アフリカ諸国が立場を統一させようとしている。

Ministers and civil society leaders from 18 African countries, U.N. disarmament officials, and arms-control advocates are meeting in the Kenyan capital Nairobi to try to form a united position on a proposed treaty to regulate the global arms trade. As VOA Correspondent Alisha Ryu reports from Nairobi, the arms treaty is viewed as a critical element in international efforts to reduce the human and economic cost of conflicts, especially in Africa.

Speaking at the opening of the arms treaty conference on Wednesday, Kenya's Assistant Foreign Minister Richard Onyonka urged quick ratification of the Arms Trade Treaty, saying that unregulated weapons sales posed one of the biggest threats to long-term development in Africa.
武器貿易条約会議の開会式が水曜日に行われ、ケニヤの外務大臣補佐官であるリチャード・オニョンカ氏が演説に立ち、武器貿易条約の速やかな批准を訴えた。オニョンカ氏は、野放し状態となっている武器の売却が、アフリカの長期的な発展にとっての最大の脅威となっていると指摘する。

"Development and reduction of violence go hand-in-hand. Long-term development is impossible without long-term security. The linkage could not find a better context than the situation in Africa. The cost of armed conflicts and violence, as well as the concomitant human tragedy here in Africa, is conservatively estimated at $18 billion annually," he said.
オニョンカ氏は「暴力の減少があってこそ、発展がある。長期の安全保障なくして、長期の発展もない。この関係性は、アフリカの状況をよく表わしている。アフリカの人道的悲劇を引き起こす武力紛争と暴力による損失は、控えめに見積もっても、年間180億ドルに達する」と述べた。

The cost is mostly through lost human and economic potential and it is roughly equivalent to the amount of aid that the continent receives from donor nations each year.
人的・経済的潜在力を失う損失は、大雑把に計算すると、アフリカが毎年、ドナー国から受け取る財政支援に匹敵するものだ。

The proposed treaty would not to ban the sale of conventional arms. But it would establish common standards that all nations would have to abide by, including prohibiting the transfer of weapons if they are likely to be used to violate human rights and humanitarian law or if they could fuel an existing conflict or hinder development.
武器貿易条約案は、通常兵器の販売を禁止するものではない。しかし、すべての国が拘束される共通の基準を確立をめざすものであり、同時に国際人権法と国際人道法に違反し、兵器を使用する恐れのある国、もしくは紛争を煽り、発展を妨げようとする者への武器の移転も禁止する。

The head of the U.N.'s Conventional Arms Branch for Disarmament Affairs Daniel Prins tells VOA that such standards are urgently needed because the global arms trade is believed to be adding eight million more guns a year to the 650 million in circulation around the world. And 60 percent of those guns are in the hands of civilians, most of them in developing countries.
国連軍縮局通常兵器部のダニエル・プリンス部長はVOAの取材に応じ、グローバルな武器貿易により、取引されている銃器が1年ごとに800万丁増えており、6億5000万丁もの銃器が世界中に出回っているといわれている。武器貿易条約の成立は喫緊の要請であるといえる。また、世界中に出回っている銃器の60%が文民の手に渡っており、そのほとんどが発展途上国で暮らす人々であると述べた。

"Many states do not have a framework of rules under which they would export or import weapons and that is very much needed because we see that the old structure in the world, where you have a few producers and many recipients of arms, do not count anymore. For instance, we see in the field of small arms that there are now more than 100 countries that produce arms," he said.
プリンス部長は、また、「多くの国が兵器の輸入、もしくは輸出に関わるルールを設けていないため、ルールの確立が急がれている。世界的な武器貿易の構造は、武器の生産者はわずかだが、受取手は多数であると考えるのはもう古く、もはや通用しない。例えば小型武器について言えば、現在、100カ国以上が武器の生産者となっているのだ」と指摘する。

At the U.N. General Assembly two years ago, 153 states voted in favor of the Arms Trade Treaty, 24 states abstained, and the world's largest arms exporter, the United States, voted against it. The Bush administration was criticized for arguing that the treaty was unnecessary because the United States and other major exporting countries have strict national rules governing arms exports.
国連総会は2年前、武器貿易条約についての検討を開始する決議を採択した。153カ国が賛成し、23カ国が棄権している。世界最大の武器輸出国である米国は反対票を投じた。ブッシュ米政権は、米国とその他の主要な武器輸出国は、すでに武器の輸出を規制する厳格なルールを設けており、武器貿易条約は不必要であると反対理由を述べた。

Ambassador Philip Richard Owade from the Permanent Mission of Kenya to the United Nations in Geneva says he believes it is up to countries that suffer the most from arms proliferation to show unity in favoring the passage of an arms treaty and help move the process toward a global consensus. "As you know, treaties quite often do not have to be universal from the word, 'go.' Those who are willing would go ahead and then develop norms that we hope in the end, even those who are against it would be able to embrace," he said.
ケニヤの政府代表部からジュネーブにある国連欧州本部に出向しているフィリップ・リチャード大使は、兵器の拡散による問題の深刻さを実感している国次第であり、そうした国々が条約の採択に向け団結していけば、グローバルなコンセンサスを醸成していく交渉プロセスを動かしていくことができると考えている。リチャード氏は「こうした条約が「成立」したということをもって、普遍性を伴う必要はない。条約に賛同する者がまずは先導し、規範の中身を吟味していく中で、最終的に条約に反対する者も包含していくことができるようになればよい」と語る。

Under the treaty, governments would also be required to report their arms transfers to an international register, a move which arms control advocates say will lead to greater public scrutiny and confidence.
武器貿易条約は、各国政府が武器の移転について、兵器に関する国際登録の際に報告することが求められている。武器貿易規制の賛同者は、武器貿易の審査と信頼醸成を高めていくことにつながると評価している。

Recent revelations of illegal transfers of sensitive materials by Japanese companies has again highlighted the fact that controlling the spread of dual-use materials remains a daunting challenge--even for a country with an advanced export-control system such as Japan.
日本企業が違法に機微な物資を移転していたことが最近、発覚し、日本のように進んだ輸出規制体制を確立している国であっても、汎用物資の拡散を規制することは極めて困難であるとの事実が、改めて明らかになった。

In one recent case, Japanese authorities suspect that the Hiroshima-based Horkos Corporation knowingly falsified equipment specifications so it could export high-precision machinery to countries without applying for an export license. Another recent case involves Tokyo Vacuum and the Nakano Corporation, whose products were discovered by International Atomic Energy Agency (IAEA) inspectors in North Korean nuclear facilities. Prior to either of these cases, the Mitutoyo Corporation--the largest producer of high-tech precision-measuring machines in the world--was found to have supplied three-dimensional measuring devices to entities working with the A. Q. Khan network, among others.
日本当局が、広島県に本社を置く工作機械メーカー「ホーコス」に対して、意図的に部品の規格情報を改ざんし、輸出許可証の申請を行うことなく、高精密機器を他国に輸出したのではないかとの嫌疑をかけたのは、ここ最近のことである。国際原子力機関(IAEA)の査察官が、北朝鮮の核施設から株式会社「東京真空」と貿易代行業を営む「ナカノ・コーポレーション」の製品を発見したことも、記憶に新しい。さらに以前には、世界的にも有数の高精密機器製造会社である「ミツトヨ」が、A・Q・カーンの大量破壊兵器拡散ネットワークに加わる国などに三次元測定器を供給していたことが発覚している。

On the heels of the Mitutoyo case, Tokyo enhanced its efforts to prevent export-control violations. But while those efforts may ultimately be effective, revelations about the newest cases are a clear reminder that Japan's sophisticated dual-use technology remains a target for WMD-related illicit trafficking networks.
ミツトヨ事件を受けて、日本政府は、輸出規制のルール違反を防止するための取り組みを強化した。こうした日本政府の取り組みは極めて有効であったといえる一方、その後も新たなケースが発覚するにつれ、日本の高度な汎用技術は、未だに大量破壊兵器関連の不法取引ネットワークにとっての、格好の標的となっていることを想起させる。

The Mitutoyo case
ミツトヨのケース

Japanese authorities raided Mitutoyo's facilities on February 13, 2006, the result of an investigation that began when IAEA inspectors found two Mitutoyo precision-measuring devices at nuclear-related facilities in Libya in 2003 and 2004. (See "Evading Export Controls: Mitutoyo Corporation as a Case Study in Determined Proliferation" and "The Mitutoyo Case: Will Japan Learn from Its Mistakes or Repeat Them?") These devices were dual-use items that could assist in manufacturing centrifuges to enrich uranium for nuclear weapons. As evidence against the company mounted, it became clear to Japanese authorities that Mitutoyo had been intentionally skirting export controls for more than a decade. According to Japanese investigators, Mitutoyo may have transferred as many as 10,000 highly accurate measuring devices in a 10-year period without proper licenses.
日本当局は2006年2月13日、ミツトヨの工場施設の家宅捜索を行った。IAEAが2003年と2004年に、リビアの核関連施設からミツトヨ製の精密測定機器を2台発見したことを受け、調査が始まり、家宅捜査に至った。リビアで発見された精密測定機器は汎用品であり、核兵器用のウラン濃縮を実施する遠心分離器の製造に利用できる。ミツトヨの非を示す証拠も増え、日本当局は、ミツトヨが数十年にわたり、意図的に輸出規制のルールの網をかいくぐってきたとの確信を持つようになった。日本の調査官によると、ミツトヨは10年間、輸出許可証を得ずに、1万台もの高精密測定機器を他国に移送してきたという。

The Mitutoyo violations were particularly egregious because of the company's prominence and the extent to which its management oversaw the violation efforts. In the early 1990s, as Japan increased control of certain dual-use items--such as Mitutoyo's three-dimensional measuring devices--company executives became concerned that tougher restrictions would cut into their profits.
ミツトヨの違反行為は、その知名度の高さ故に、ある程度大目に見られてきたという意味で、悪質であったといえよう。1990年代初頭、日本政府は規制対象となる汎用品の数を増やした。ミツトヨが輸出していた三次元測定器も規制対象となり、同社の幹部は、規制強化による利益の縮小を恐れるようになった。

In response, Mitutoyo's leadership established the "export management committee" that oversaw the development of methods for exploiting weaknesses in Japan's export-control system. The committee ingeniously created a software program--sardonically code-named "CoCom" after the multilateral export-control regime--that made Mitutoyo's precision-measuring equipment appear less accurate than it actually was. Once installed, this software allowed Mitutoyo to declare that the equipment being shipped was below the threshold requiring an export license. Therefore, if Japanese custom authorities checked the machine prior to export, the software would mask the device's true accuracy.
そこで、ミツトヨの首脳部は「輸出管理委員会」を設置し、日本の輸出規制体制の穴を抜けるための手法を確立させていった。輸出管理委員会は、輸出規制のための多国間の枠組みにちなみ、皮肉を込めて名付けられた「ココム」というコードネームのソフトウエア・プログラム開発を巧妙に進め、ミツトヨが製造した精密機器が、実際よりも低品質であるかのように認識させるようにした。このソフトウエア開発により、ミツトヨ製の機器は、輸出許可証が求められる基準以下の製品として、船積みされることとなった。日本の関税当局が輸出前に機器を検査したとしても、ソフトウエアにより、機器の本来の品質データが改ざんされてしまうのである。

The company also systematically relied on its subsidiaries to facilitate its illegal transfers, and its Singapore and Malaysia offices became important conduits for sales to third countries. For example, between 1992 and 1995, the number of exports by Mitutoyo to its subsidiary in Singapore soared from 20-30 annually to approximately 200 per year. In 2001, two measuring devices were exported via Mitutoyo's Singapore subsidiary to Scomi Precision Engineering (SCOPE) in Malaysia. SCOPE played a key role in the Khan network's efforts to supply Libya with a nuclear weapons program, with Khan associate B. S. A. Tahir establishing the Malaysian firm to manufacture centrifuge components for Libya. The Mitutoyo measuring devices were retransferred by Tahir to Libya via Dubai between December 2001 and December 2002, where the IAEA discovered them.

In June 2007, four former Mitutoyo executives were convicted of numerous export control violations, but each received suspended sentences--thus, escaping jail time. Mitutoyo itself paid a $350,000 fine and received a multi-phased export ban. The ban lasts three years--the maximum duration allowed under Japanese law. But because the ban only targets specific items and includes exceptions for customers in countries considered "safe" (i.e., the United States), the company isn't expected to suffer long-term setbacks.
2007年6月には、ミツトヨの元幹部の4人が、輸出規制のルール違反で有罪となったが、刑は執行猶予され、懲役から逃れている。ミツトヨ自体は、35万ドルの罰金を支払い、多段階的な禁輸措置を受けている。禁輸措置の期限は3年で、日本の法律の最長期限である。しかし、禁輸措置は特定の物資のみを対象としており、「安全」と考えられる国(例えば米国)の取引先であれば問題としないという例外も含まれているため、ミツトヨにとって、長期に及ぶ痛手とはなっていないと思われる。

Although many saw the Mitutoyo case as an aberration, on July 31, the Metropolitan Police Department's Public Security Bureau and Hiroshima police raided the Horkos Corporation on suspicion that the company had illegally exported dual-use machine tools that could be used to develop nuclear weapons. Authorities believe that the items, called machining centers, were illegally transferred to a number of countries between 2004 and 2006.
ミツトヨのケースは例外的な事例だと考えられていたが、今年の7月31日には、警視庁公安部と広島県警が、核兵器開発に利用可能な汎用工作機械を違法に輸出していた疑いで、ホーコス・コーポレーションを家宅捜索した。捜査当局は、2004年から2006年にかけて、複合工作機械と呼ばれる製品が多くの国に違法に移送された確信している。

Although the exported machines can be used to manufacture automotive components and other civilian devices, they can also be used to produce components for centrifuge separation devices for uranium enrichment. Due to their dual-use nature, machine centers are controlled by Japan under its Foreign Exchange and Foreign Trade Law, and exporters need to obtain an export license from the Ministry of Economy, Trade, and Industry (METI).
ホーコスが輸出していた機械は自動車部品などの民生用品の製造に使われるものでもあるが、ウラン濃縮を行う遠心分離器を製造するための部品としても利用できる。複合工作機械は軍民両用の性質を兼ね備えているため、日本の外為法により規制され、輸出する場合は、経済産業省から輸出許可証を得なければならない。

To avoid METI's licensing requirements, Horkos declared at the time of export that its machines were of a lower caliber. Relevant company officials reportedly approved of the unauthorized exports and multiple Horkos employees are accused of falsifying customs declarations. (See "Toolmaker Probed for Nuke-Linked Illicit Trade") It remains unclear if the company was aware that its products could be diverted for military purposes.

Japanese authorities have been particularly concerned about Horkos exports to South Korea, which may have been re-exported to North Korea or unspecified Middle Eastern countries. The police haven't released details about the South Korean company, so it's unclear why these transfers have raised particular concern. Horkos is also being investigated for questionable transfers to China, Thailand, France, and the United States. In total, Horkos is suspected of having exported more than 200 machines centers over a two-year period in violation of Japanese export control laws.1

Like Mitutoyo, Horkos is a prominent company; in 2007, it employed 665 people and generated $192 million in sales. The involvement of such a well-established firm in what authorities believe was a coordinated effort to elude export-control requirements raises the question of whether Japan's current system can sufficiently deter companies from seeking profits at the expense of security.
ホーコスもミツトヨと同様、日本有数の企業であり、2007年現在、665人の従業員を抱え、1億9200万ドルの売上利益を得ている。日本当局が疑う、そうした一流企業の不正輸出への関与は、輸出を規制するルールを回避するための協調的な努力であると考えられ、日本の現在のシステムが、日本企業が安全保障上の配慮を犠牲にして、利益追求に走ることを効果的に阻止することが出来ているのかどうかについて、疑念を抱かせるものである。

The Tokyo Vacuum and Nakano Corporation cases

In mid-June, Japanese authorities raided the facilities of Tokyo Vacuum, located in Sagamihara, and the Nakano Corporation, a Tokyo trading company, suspected of the unlicensed export of vacuum pumps usable in uranium enrichment. As in the Mitutoyo case, the raids stemmed from findings made by the IAEA--this time as a result of inspections undertaken by the agency in July 2007 at the Yongbyon nuclear complex and other nuclear-related facilities in North Korea.2 Japanese authorities identified the transferred items PDF [in Japanese] as an oil-diffusion pump, oil-rotary pump, and other relevant components. While there's been previous speculation that Japanese-origin products were used in developing Pyongyang's nuclear weapons, this was the first confirmed finding of such equipment at a North Korean facility.3
6月中頃、日本当局は、ウラン濃縮に利用できる真空ポンプを、許可なく輸出していた疑いで、相模原にある東京真空の施設と、東京の貿易会社であるナカノ・コーポレーションを家宅捜索した。ミツトヨのときと同様、IAEAの調査で発覚した事実に基づき、家宅捜査を行うに至っている。家宅捜査の根拠となったIAEAの調査は、2007年6月に、北朝鮮の寧辺にある核関連複合施設で実施された。日本当局は、油拡散ポンプや油回転ポンプなど、関連する部品が北朝鮮に輸出されていたことを確認した。前々から日本製の機材が北朝鮮の核兵器開発に用いられているのではないかと疑われてはいたが、今回、そうした疑惑を裏付ける部品が、北朝鮮の施設から初めて発見されたことになる。

Tokyo Vacuum manufactured the pumps in question and then exported them to a customer in Taiwan by Nakano in July 2003. According to one media report, Japanese investigators suspect that the recipient was a Taipei-based trading company named Transmerits. That company appears to have then re-exported the pumps to Namchongang, a trading company in Pyongyang headed by the North Korean representative during the 2007 IAEA inspection of Yongbyon. No information has been released about the Taiwanese company and whether Taiwanese authorities are pursuing an export-control violation case against it. The pumps were reportedly used at North Korean nuclear facilities to remove impure substances from plutonium under strong vacuum pressure.4
問題となっているポンプを製造したのは東京真空で、2003年6月に、ナカノ・コーポレーションが台湾の顧客に、東京真空製のポンプを輸出したということになっている。報道によると、日本の調査官は、台北にある「蓮笙興業有限公司(トランスメリット)」という貿易会社が、取引相手ではないかと疑っているという。IAEAが2007年に寧辺で調査を実施している間、トランスメリットは東京真空製のポンプを、北朝鮮の平壌にある貿易会社「南川江(ナムチョガン)」に再輸出していたと思われる。トランスメリットについての情報はもたらされておらず、台湾当局が、輸出規制のためのルール違反でトランスメリットを追求しているのかどうかも分からない。報道では、強い減圧でプルトニウムを精製するため、北朝鮮の核施設で、東京真空製のポンプが使われたと見られているという。

After the raid, Nakano's president claimed he wasn't aware that the pumps would be re-exported to North Korea and that the manufacturer had told the trading company that the equipment didn't require an export license.5 But according to a METI press release PDF [in Japanese], Nakano later admitted to investigators that the company recognized at the time of the transfer that the equipment could be re-exported to North Korea. Ultimately, government prosecutors chose not to press formal charges against Nakano because they couldn't prove that the president or anyone else in the company was aware that the pumps would be used for North Korea's nuclear weapons development.6 METI did issue a stern warning PDF [in Japanese] on August 8 to Nakano about abiding by domestic export-control laws.

Both Tokyo Vacuum and Nakano had long-established trading partnerships with Taiwanese companies, and the transactions that led to the violations could have been easily overlooked by Japanese authorities since the Taiwanese end-user wasn't subject to strict export-control requirements. Unlike the Mitutoyo or Horkos, this case doesn't appear to be a result of blatant disregard for Japanese export controls, but instead, a lack of awareness and due diligence on the part of the companies concerned. Such a lack of awareness about export-control requirements among small- and medium-sized Japanese enterprises has been cited as a major cause of unauthorized transfers of sensitive dual-use products.

The challenge of keeping up with proliferation
対拡散政策に向けた挑戦

A significant amount of Japan's foreign trade and industry is based on the manufacturing of advanced technology, much of which has dual-use applications. In this way, Tokyo's ability to control its trade in sensitive materials has a serious impact on international security and nonproliferation. As the recent violations make clear, the Japanese export-control system is struggling to keep up with the rapid growth in dual-use technology and globalized trade. Japan isn't alone, as export-control violations by U.S. and European companies highlight.7 The constantly changing nature of modern technology means that the governments of industrialized nations must struggle with the maintenance of control lists and export-control regulations that are outdated almost as soon as they're published.
日本の対外貿易と産業は、大部分が、汎用性を伴う先進技術の開発に基づいている。従って、機微な物資の貿易を規制する日本政府の能力が、国際安全保障と兵器の不拡散の前途を大きく左右する。これまで見てきたケースにより明らかになったことは、汎用技術の急速な発展と貿易のグローバル化に後れを取らぬよう、日本の輸出規制体制は必死にもがいているということである。米国や欧州の企業による輸出規制ルール違反が浮き彫りになったように、日本だけの話というわけでもない。現代技術の性質が常に変化する中、先進国の政府は、公表した途端に時代遅れとなる輸出規制のルールや規制対象のリストの管理に四苦八苦しなければならない。

Japan's proximity to North Korea further complicates Tokyo's efforts. North Korea's missile and nuclear programs are seen as significant threats to Japan's domestic security, so stopping Pyongyang's procurement of Japanese dual-use technology has been a driving force in Tokyo's nonproliferation efforts. After North Korea's 2006 missile and nuclear tests, the Japanese government significantly tightened export-control regulations targeting North Korea in an effort to close off potential loopholes for illegal exports to Pyongyang.8
日本と北朝鮮の地理的な近さが、日本政府の輸出規制の努力を、一層複雑なものにさせる。北朝鮮のミサイルと核兵器開発は、日本の安全にとって深刻な脅威であり、北朝鮮による日本の汎用技術の獲得を阻止することが、日本政府の不拡散に向けた努力の原動力となっている。北朝鮮が2006年にミサイル発射実験と核実験を行った後、日本政府は、北朝鮮に違法にゆしゅつするための潜在的な抜け穴をふさぐことで、北朝鮮を対象にした輸出規制のルールを強化した。

High-profile violation cases such as Mitutoyo, along with heightened global concern about proliferation, prompted Tokyo to take other recent steps to prevent further diversion of Japanese-origin products and technologies to WMD-related programs. In April 2006, METI established a working group of export control and nonproliferation experts under the Industrial Structure Council's Subcommittee on Security Export Control to assist Japanese authorities in preventing the illicit transfer of sensitive technologies. In 2007, the working group submitted its recommendations, which included strengthened penalties for export-control violations. Under the new rules put forth by the Japanese government--not yet formally approved by parliament--levels of fines for export-control violations would increase at least tenfold, bringing the maximum fine up to $184,000 per item transferred.9

Tokyo is also improving the compliance of all companies, no matter the size. As the Mitutoyo and Horkos cases demonstrated, large companies with an understanding of their export-control responsibilities are hard to deter unless fines and criminal penalties possess significant teeth. But smaller companies such as Tokyo Vacuum and Nakano often plead ignorance--rightfully or wrongfully. To counter this, Japan's export-control system is focusing more attention on industry outreach and promoting internal compliance programs. Tokyo first spearheaded efforts to improve internal compliance programs after problems surfaced with export-control violations in the late 1980s. (See "Japan's Export Control Initiatives: Meeting New Nonproliferation Challenges" PDF) But while most of Japan's larger companies have internal compliance programs, the programs in many small- and medium-sized companies are still lacking.

Therefore, Japan must continue to work with industry to raise awareness of the security ramifications of noncompliance with export controls and make clear that companies that don't take export restrictions seriously will suffer financial and legal consequences. Because with so many Japanese companies involved with highly sensitive dual-use items, the potential for more violations to occur remains.
従って、日本政府は、引き続き、産業界と協力しながら、輸出を規制するルールの不遵守が安全保障に及ぼす悪影響についての問題意識を惹起させる努力を進め、輸出制限のためのルールを厳格に守らない企業は、財政的、かつ法的に、損害を被ることになるということを明確にさせなければならない。あまりにも多くの日本企業が機微な汎用品の製造にかかわっており、さらなる違反行為が生じる可能性は残っているのだから。

WASHINGTON (Reuters) - U.S. government-brokered overseas arms sales are expected to total about $34 billion in the current fiscal year, up more than 45 percent from the year before, the Pentagon agency in charge said on Wednesday.

In fiscal 2007, such sales totaled $23.3 billion, up from $21 billion in fiscal 2006, according to the security agency's figures.

Farmer, at the conference known as ComDef 2008, said her agency was playing a growing role in the U.S.-declared global war on terrorism and national security.

The United States carries out government-to-government conventional arms transfers through the Defense Department's Foreign Military Sales program, which operates on a no-profit, no-loss basis.

In 2007, the Pentagon notified Congress of more than $39 billion in such potential sales to 23 countries and Chinese-claimed Taiwan, including some funded by grant aid.

Critics say booming sales reflect a failure of U.S. diplomacy and show a need for the United States to rethink how it handles foreign policy.

"Instead of spending millions or billions of dollars on weaponry, many U.S. arms customers should be funding education, health, and infrastructure programs that would go much further in improving the long-term stability of their countries," said Wade Boese, research director of the Arms Control Association, a nonpartisan group aimed at curbing the spread of weapons.

パキスタンの軍統合情報部(ISI)

アフガニスタンで活動していたNGO「ペシャワール会」の伊藤さんを
拉致し、殺害した犯人の一人であるアディル・シャー容疑者が
「パキスタンの軍統合情報部(ISI)に仲間が依頼されて」、伊藤さんを殺害したと
供述しているとのアフガニスタン当局の発表が、数日前に報じられていた。

その後、朝日新聞がシャー容疑者に単独取材したところ
シャー容疑者は、動機について「金目当てだった」と述べ、
政治的な意図を否定したという。
ISI云々という胡散臭い話は、おそらくISIを目の敵にしている
アフガン当局が、そういうことを言わせるような
尋問をしたためだと推察される。
シャー容疑者を犯行に誘い、依然逃亡中の仲間も
単なる人質売買のブローカーの類で、
ISIの依頼を受けたとは到底考えられない。

一方で、アフガニスタンの治安を揺るがしている主たる原因の一つが
ISIであるということは、よく指摘されており
アフガニスタン政府は、取り敢えず何でもかんでもISIのせいにして
自身の統治能力に対する批判を回避している風にさえ思えるような
説明をよくする。

Pakistan's intelligence agency, the Inter-Services Intelligence (ISI), has long faced accusations of meddling in the affairs of its neighbors. A range of officials inside and outside Pakistan have stepped up suggestions of links between the ISI and terrorist groups in recent years. In autumn 2006, a leaked report by a British Defense Ministry think tank charged, "Indirectly Pakistan (through the ISI) has been supporting terrorism and extremism—whether in London on 7/7, or in Afghanistan, or Iraq." In June 2008, Afghan officials accused Pakistan's intelligence service of plotting a failed assassination attempt on President Hamid Karzai; shortly thereafter, they implied the ISI's involvement in a July 2008 attack on the Indian embassy. In an October 2006 interview, Pakistani President Pervez Musharraf said some retired ISI operatives could be abetting the Taliban insurgency in Afghanistan, but he denied any active links. Pakistan's government has repeatedly denied allegations of supporting terrorism, citing as evidence its cooperation in the "war on terror," in which it has taken significant losses both politically and on the battlefield

"The ISI probably would not define what they've done in the past as 'terrorism,'" says William Milam, former U.S. ambassador to Pakistan. Nevertheless, experts say the ISI has supported a number of militant groups in the disputed Kashmir region between Pakistan and India, some of which are on the State Department's Foreign Terrorist Organizations list. While Pakistan has a formidable military presence near the Indian border, some experts believe the relationship between the military and some Kashmiri groups has greatly changed with the rise of militancy within Pakistan. Shuja Nawaz,author of the book Crossed Swords: Pakistan, its Army, and the Wars Within, says the ISI "has certainly lost control" of Kashmiri militant groups. According to Nawaz, some of the groups trained by the ISI to fuel insurgency in Kashmir have been implicated in bombings and attacks within Pakistan, therefore making them army targets.

On Pakistan's western border with Afghanistan, the ISI supported the Taliban up to September 11, 2001, though Pakistani officials deny any current support for the group. The ISI's first major involvement in Afghanistan came after the Soviet invasion in 1979, when it partnered with the CIA to provide weapons, money, intelligence, and training to the mujahadeen fighting the Red Army. At the time, some voices within the United States questioned the degree to which Pakistani intelligence favored extremist and anti-American fighters. Following the Soviet withdrawal, the ISI continued its involvement in Afghanistan, first supporting resistance fighters opposed to Moscow's puppet government, and later the Taliban.

Pakistan stands accused of allowing that support to continue. Afghan President Hamid Karzai has repeatedly said Pakistan trains militants and sends them across the border. In May 2006, the British chief of staff for southern Afghanistan told the Guardian, "The thinking piece of the Taliban is out of Quetta in Pakistan. It's the major headquarters." Speaking at the Council on Foreign Relations in September 2006, President Musharraf responded to such accusations, saying, "It is the most ridiculous thought that the Taliban headquarters can be in Quetta." Nevertheless, experts generally suspect Pakistan still provides some support to the Taliban, though probably not to the extent it did in the past. "If they're giving them support," Kathy Gannon, who covered the region for decades for the Associated Press says, "it's access back and forth [to Afghanistan] and the ability to find safe haven."

Many in the Pakistani government, including slain former Prime Minister Benazir Bhutto, have called the intelligence agency "a state within a state," working beyond the government's control and pursuing its own foreign policy. But Nawaz says the intelligence agency does not function independently. "It aligns itself to the power center," and does what the government or the army asks it to do, says Nawaz.

Control over the ISI

Constitutionally, the agency is acountable to the prime minister, says Hassan Abbas, research fellow at Harvard's Kennedy School of Government. But most officers in the ISI are from the army, so that is where their loyalties and interests lie, he says. Experts say until the end of 2007, as army chief and president, Musharraf exercised firm control over the intelligence agency. But now, Abbas says, "he is the third player in the game." With a new army chief and a new prime minister in Pakistan gaining increasing control of the agency, Musharraf has no direct control over it. But he still wields influence, Abbas says, in the form of a close former associate, Lieutenant-General Nadeem Taj, who heads the intelligence agency.

"I do not accept the thesis that the ISI is a rogue organization," Milam says. "It's a disciplined army unit that does what it's told, though it may push the envelope sometimes." With a reported staff of ten thousand, ISI is hardly monolithic: "Like in any secret service, there are rogue elements," says Frederic Grare, a South Asia expert and visiting scholar at the Carnegie Endowment for International Peace. He points out that many of the ISI's agents have ethnic and cultural ties to Afghan insurgents, and naturally sympathize with them. Marvin G. Weinbaum, an expert on Afghanistan and Pakistan at the Middle East Institute, says Pakistan has sent "retired" ISI agents on missions the government could not officially endorse. Some observers believe Pakistan's duplicity is deliberate: "Musharraf's been playing with us since day one," Grare says.

Pakistan's tribal areas along the Afghan border have emerged as safe havens for terrorists. Experts say because of their links to the Taliban and other militant groups, the ISI has some influence in the region. But with the mushrooming of armed groups in the tribal agencies, it is hard to say which ones the agency controls. Also, there appears to be division within the ISI. While some within the intelligence agency continue to sympathize with the militant groups, Harvard's Abbas says others realise they cannot follow a policy contradictory to that of the army, which is directly involved in counterterrorism operations in the area.

Mixed Record on Counterterrorism

Pakistan has arrested scores of al-Qaeda affiliates, including Khalid SheikhMohammed, the alleged mastermind of the 9/11 attacks. The ISI and the Pakistani military have worked effectively with the United States to pursue the remnants of al-Qaeda. Following 9/11, Pakistan also stationed eighty thousand troops in the troubled province of Waziristan near the Afghan border. Hundreds of Pakistani soldiers died there in resulting clashes with militants, which in 2006 Musharraf told a CFR meeting "broke the al-Qaeda network's back in Pakistan."
But Musharraf has cracked down on terrorist groups selectively, as this Backgrounder points out. Weinbaum in 2006 said the Pakistani military has largely ignored Taliban fighters on its soil. "There are extremist groups that are beyond the pale with which the ISI has no influence at all," he says. "Those are the ones they go after." In spring 2008, Ashley J. Tellis, senior associate at the Carnegie Endowment for International Peace, writes (PDF) in The Washington Quarterly that Musharraf tightened pressure on groups whose objectives were out of sync with the military's perception of Pakistan's national interest.

Taliban as a Strategic Asset

Pakistan does not enjoy good relations with the current leadership of Afghanistan, partly because of rhetorical clashes with Afghan President Hamid Karzai, and partly because Karzai has made strong ties to India. Some experts say Pakistan wants to see a stable, friendlier government emerge in Afghanistan. Though the insurgency certainly doesn't serve this goal, increased Taliban influence, especially in the government, might. Supporting the Taliban also allows Pakistan to hedge its bets should the NATO coalition pull out of Afghanistan. In a February 2008 interview with CFR.org, Tellis said the Pakistani intelligence services continue to support the Taliban because they see the Taliban leadership "as a strategic asset," a reliable back-up force in case things go sour in Afghanistan.
Not everyone agrees with this analysis. According to Weinbaum, Pakistan has two policies. One is an official policy of promoting stability in Afghanistan; the other is an unofficial policy of supporting jihadis in order to appease political forces within Pakistan. "The second [policy] undermines the first one," he says. Nawaz says there is ambivalence within the army regarding support for the Taliban. "They'd rather not deal with the Afghan Taliban as an adversary," he says.

Indian officials claim to have evidence that the ISI planned the July 2006 bombing of the Mumbai commuter trains, but the charges seem unlikely to some observers of the long, difficult India-Pakistan relationship. The two nations have a history of finger-pointing, and while some of the allegations hold water, there is a tendency to exaggerate. Furthermore, endorsing an attack on India would undermine Musharraf's own policy. "Pakistan is genuinely trying to open up relations with India," Gannon says.

In Weinbaum's view, the British report regarding its July 2005 bombings—which London insists is not a statement of policy—makes "too broad a statement." Though Pakistan does offer safe haven to Kashmiri groups, and perhaps some Taliban fighters, the suggestion that the ISI is responsible for the 7/7 bombings of London's mass transit system is "a real stretch," Gannon says.

At an emergency Sept. 1 meeting in Brussels, European Union leaders adopted the unexpectedly stern stance of threatening to suspend negotiations with Moscow on a renewed cooperative framework agreement unless Russian troops withdraw from Georgia. The decision was amplified by the drama of the gathering, which represented the first emergency session of the EU heads of government, formally known as the European Council, since the beginning of the 2003 Gulf War.

According to the statement of the Extraordinary European Council, "Until troops have withdrawn to the positions held prior to 7 August," when they first intervened in Georgia, "meetings on the negotiation of the Partnership Agreement will be postponed" beyond their scheduled Sept. 15 start date. The heads of the 27 EU governments also explicitly condemned Russia's "disproportionate reaction" to the South Ossetian crisis, rejected as "unacceptable" Moscow's decision to recognize the independence of Abkhazia and South Ossetia, and urged other national governments to refrain from offering similar recognition.

French President Nicolas Sarkozy, whose country holds the rotating EU presidency, will lead a high-level EU delegation to Moscow and Tbilisi on Sept. 8 to review implementation of the six- point peace plan he negotiated between Russia and Georgia last month. If Sarkozy, European Commission President José Manuel Barroso, and EU foreign policy chief Javier Solana find that Russia is not fulfilling its commitment to withdraw troops by then, the EU would postpone the opening of the talks on a new Partnership and Cooperation Agreement (PCA).

Russian representatives claim they have already redeployed their regular troops behind the ceasefire lines and that only "peacekeepers" remain on Georgian territory to establish a buffer zone outside the two separatist regions. The EU governments, seeking to undercut Moscow's justification for their presence, offered to deploy hundreds of unarmed ceasefire monitors in their place.

The European Council session saw some of the same divisions that split last month's NATO summit. The representatives of France, Germany, and Italy, fearful of a renewed Cold War, advocated continued negotiations with Russia and further EU-led mediation between Moscow and Georgia. The governments of Britain, Poland, and the Baltic states wanted to adopt a harder line, including possible economic sanctions against Russia. Polish Foreign Minister Radoslaw Sikorski observed that, while everyone wanted to avoid another Cold War, "If we get it, I have no doubts who will win it."

The widespread reluctance to impose economic sanctions on Russia resulted from a perception that these coercive measures could hurt Europeans much more than Russians after Moscow retaliated. EU countries currently import on average about 40 percent of their natural gas and one-third of their oil from Russia or through Russian-controlled pipelines. In addition, Russia is presently the EU's third-largest trade partner, after the United States and China, while the EU is Russia's largest trading partner, accounting for almost half of Moscow's foreign trade.

Instead of threatening Moscow with sanctions, the European Council offered financial and other support for Georgia's beleaguered government. The EU leaders pledged a direct $110 million grant and offered to organize an international donors' conference to raise additional funds. The EU leaders also stated they would consider establishing a free trade area encompassing Georgia and relaxing visa rules for Georgian citizens, which are often stricter than those the EU imposes on Russians seeking entry. "I think we found an excellent compromise," German Chancellor Angela Merkel later argued, "not going back to business as usual, but still making clear that we want to maintain contact with Russia."

After the meeting, Sarkozy told a press conference that the ball now lay in Russia's court: "The question is, what does Russia want? Does it want . . . cooperation, or confrontation?" Sarkozy rejected the notion of giving Moscow a special sphere of influence in the former Soviet republics, observing that, "Yalta is behind us." At the February 1945 conference in Yalta, U.S. President Franklin D. Roosevelt and British Prime Minister Winston Churchill led Soviet Premier Joseph Stalin to conclude that the Western democracies had granted Moscow primacy in much of Eastern Europe. The Cold War arose after Soviet troops began installing puppet governments in these countries despite subsequent Western objections.

EU External Affairs Commissioner Benita Ferrero-Waldner later told the European Parliament the EU intended to extend support to other former Soviet bloc countries to "underline that we will not accept new dividing lines in Europe, and that partners like Georgia, Ukraine and Moldova can count on our support for their territorial integrity and sovereignty."

The White House welcomed the EU decision as demonstrating that "Europe and the United States are united in standing firm behind Georgia's territorial integrity, sovereignty and reconstruction." White House spokeswoman Dana Perino said Washington would participate in the planned donors' conference and provide its own economic assistance to help Georgia recover from the war. Perino also announced that Vice President Dick Cheney would soon visit Georgia as well as Azerbaijan and Ukraine to conduct a fact finding mission to determine an appropriate course of action. Cheney's itinerary would allow him to reaffirm U.S. interest in the region -- especially as an energy corridor between Central Asia and Europe -- and reject Moscow's claimed primacy in the former Soviet space.

In its first answer to Sarkozy's rhetorical question, Russia's EU envoy Vladimir Chizhov, echoing the assertions of other Russian government officials that they were prepared to engage in another Cold War if necessary, responded that "We don't need these talks or this new agreement any more than the EU does." Russian leaders continue to demand that Western governments abandon Georgian President Mikheil Saakashvili, whom they hold responsible for the war, in order to maintain good relations with Moscow. When asked about the possibility of EU sanctions on Moscow, Foreign Minister Sergei Lavrov replied that the EU and the rest of the international community could best "impose an embargo on arms supplies on that regime until different leaders have turned Georgia into a normal country."

The day after the summit, the Russian Foreign Ministry issued a statement praising the EU for rejecting the more confrontational proposals of some of its members. "There were calls from some states to impose sanctions on Russia and freeze relations . . . but the main thing is that . . . the majority of EU states showed a responsible approach and confirmed their course towards partnership with Russia, realizing all too well the importance of mutually beneficial cooperation." Much of the Russian press was even more enthusiastic, describing the EU failure to impose sanctions as a victory of Russian diplomacy.
